1. Acceptance of these terms

By accessing or using theimgapp.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. We may update these Terms from time to time; the "Last updated" date above will reflect the most recent revision. Continued use of the Service after a change constitutes acceptance of the revised Terms.

2. The Service

theimgapp provides a collection of free, browser-based image processing utilities. The majority of operations run directly in your browser. Where server-side processing is used, files are handled in memory and discarded immediately after the response is sent. See our Privacy page for full details on how data is handled.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Acceptable use

You agree not to use the Service to:

  • Process content that you do not own or have permission to use, including copyrighted images, trademarks, or content protected by other intellectual-property rights.
  • Create, distribute, or store images depicting child sexual abuse material (CSAM), non-consensual intimate imagery, or any content that exploits, harms, or endangers minors.
  • Generate content that promotes violence, terrorism, hate speech, harassment, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  • Create, distribute, or facilitate the distribution of deceptive media intended to defraud, impersonate, or harm others, including non-consensual deepfakes.
  • Attempt to disrupt, overload, reverse-engineer, scrape, or circumvent the Service's technical limits, rate limiting, or security mechanisms.
  • Use the Service to develop, train, or fine-tune machine-learning systems on third-party content you do not have rights to.
  • Use the Service for any purpose that violates applicable local, national, or international law.

We reserve the right to block IP addresses or restrict access if we detect abuse, but because we do not store your files or operate user accounts, enforcement is limited to network-level controls.

5. Your content

You retain all ownership rights to the images and other files you process through the Service. theimgapp does not claim any ownership, license, or rights to your content. We do not store, log, share, or train any system on your files. You are solely responsible for ensuring you have the legal right to upload and process whatever content you submit.

6. Intellectual property

The Service, including its software, design, branding, text, graphics, and logos, is owned by theimgapp and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written permission, except as expressly permitted by these Terms or applicable law.

The "theimgapp" name and logo are trademarks of theimgapp. All other trademarks, product names, and brands are the property of their respective owners and are used only for identification.

7. Third-party services

The Service uses Google Analytics for anonymous traffic measurement and Google AdSense to display advertisements. These third parties have their own privacy policies and terms of service. Your use of those services through theimgapp is also subject to their respective terms. We do not control and are not responsible for the content of any third-party advertisements or linked sites.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or completely secure.

Image processing results may vary based on input file characteristics, browser, device, and network conditions. theimgapp does not guarantee a specific quality, file size, or compatibility outcome for any tool. You should always verify processed files before relying on them in production or shipping them to clients.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall theimgapp, its operators, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.

Our total cumulative liability for any claim arising out of or in connection with these Terms or the Service shall not exceed one hundred US dollars (USD 100). Some jurisdictions do not allow the limitation of certain liabilities, so part or all of this limitation may not apply to you.

10. Indemnification

You agree to indemnify and hold theimgapp harmless from any claim, demand, damages, or expense (including reasonable attorneys' fees) made by a third party arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of another.

11. Service availability and changes

We may modify, suspend, or discontinue the Service or any tool at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service. We may also remove or restrict tools that are subject to legal complaints or that we believe are being abused.

12. Copyright complaints (DMCA)

If you believe that material accessible through the Service infringes your copyright, please send a written notice to legal@theimgapp.com including: (a) identification of the copyrighted work, (b) identification of the allegedly infringing material and its URL on theimgapp, (c) your contact information, (d) a good-faith statement that the use is not authorized, and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

13. Governing law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India, except that we may seek injunctive or equitable relief in any jurisdiction where appropriate to protect our intellectual property.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
